WRC rejects driver’s working-time complaint after claim changes at hearing

By Rory Hanlon

Workplace Relations Commission ·

The Workplace Relations Commission dismissed a driver’s working-time complaint after finding that the claim raised at the hearing differed from the one on his complaint form. In a decision dated 17 May 2017, the WRC said he acknowledged that he had no complaint about rest breaks and that it could not hear the separate pay complaint raised orally at the hearing. The driver’s form alleged that he did not get 11 hours’ rest between night shifts. At the hearing, he raised a different complaint about his rate of pay compared with day-shift employees. The WRC found the complaint before it failed because it differed from the form; the merits of the separate pay complaint were not decided.
