WRC rejects health care assistant’s claim to nurse post

By Aoife Loughran

Workplace Relations Commission ·

The WRC found that a hospice was not contractually obliged to employ a health care assistant as a registered nurse after she completed a sponsored nursing degree. Her complaint was not well founded. The decision was dated 7 November 2016. The health care assistant, represented by INMO, said the hospice had agreed to employ her as a nurse for five years after the course. The hospice, represented by IBEC, said it was not a party to the sponsorship agreement and had only facilitated time off. The adjudicator found the document was an application to the HSE, witnessed by the hospice’s director, and did not commit the hospice to hiring her.
