WRC finds promotion discrimination claim was out of time

By Cathal Brosnan

Historic decision · Decision date:

Place: no local area assigned from the source.

The WRC found that an employment equality claim over an unsuccessful promotion application was brought outside the time limit and was not well founded; the merits were not decided. The decision was dated 2 May 2017. The complainant’s appeal of the promotion decision ended on 23 June 2015, and he lodged his WRC claim on 24 March 2016. He said he had been busy, did not know the time limit or where to file, and had pursued a claim with the IHREC. A Third Level Institute of Education argued the claim was late and that the appeal merely reaffirmed the original decision. The WRC treated 23 June 2015 as the relevant date but found no reasonable cause to extend the filing period.
