A hotel manager’s age discrimination complaint against a Hotellier failed after the WRC found he had not established a prima facie case. The decision was dated 8 May 2017. His separate unfair dismissal complaint was withdrawn. The manager said he was retired at 65 because of his age and argued that the retirement policy was unjustified. The Hotellier said his contract set a retirement age of 65 and that he had been invited to apply to remain in employment. The adjudication officer found that the manager had an opportunity to request an extension but did not do so before asking for his P45. The age discrimination complaint failed; the unfair dismissal complaint remained withdrawn.
