In 1999, the Labour Court raised a Rights Commissioner’s £500 recommendation to £5,000 for a Dublin Corporation assistant foreman who lost overtime after a transfer. The Services Industrial Professional Technical Union appealed on the worker’s behalf. The Court issued its decision on 30 August 1999.
The union said the worker had performed regular overtime for years at Ormond Square Park before moving to Edenmore Park. Dublin Corporation argued that the overtime was irregular and not guaranteed. The Court found that the worker had performed regular, structured overtime for 10 years and had no further overtime opportunities after the move. It recommended £5,000 in full and final settlement, amending the earlier recommendation.
