Labour Court upholds Cadbury recommendation on rotating plant warmer role

The Labour Court upheld a recommendation that Cadbury Ireland Limited rotate a plant warmer role between two production operators during future plant shutdowns. It dated its decision 13 March 1998. The Amalgamated Transport And General Workers' Union had argued that worker B had a stronger claim to the role because its duties were more closely connected to his usual job. Cadbury said the role combined duties from several jobs and should go to the most senior eligible worker. The Court said there were no compelling reasons to interfere with the Rights Commissioner's recommendation. It clarified that the rotation would be by occurrence and would apply when a future shutdown took place.
