The Labour Court recommended that Telemara Teoranta offer a worker its next suitable vacancy according to her seniority on the recall list and give her a copy of the list. The decision was dated 1 April 1997. The union, Ceardchumann Seirbhísí Tionsclaíochta Gairmiúla Teicniúla, appealed a Rights Commissioner’s recommendation that the worker’s claim of unfair selection for redundancy fail. It said more junior workers had obtained jobs while she had not been recalled. The company argued she lacked the skills for production-line work and had previously been offered other work. The Court recommended the vacancy and list access but did not accept the union’s argument for monetary compensation.
