The Labour Court rejected the Amalgamated Transport And General Workers Union’s appeal and upheld a recommendation to address an anomaly in Cadbury Ireland Limited’s sickness benefit scheme when the agreement was renewed. The decision was signed on 15 November 1995. The appeal concerned a worker who was absent through illness for five weeks and in hospital during the first two. He argued that the hospitalisation clause entitled him to five weeks at the higher payment level. Cadbury Ireland Limited said the clause applied only when hospitalisation continued after the three-week entitlement had been used.
