In 1995, the Labour Court rejected the Services Industrial Professional Technical Union’s appeal and upheld the Rights Commissioner’s recommendation that the selection procedure at Bord Na Mona was fair. The decision was signed on 2 October 1995. The union argued that Bord Na Mona did not follow its agreed procedure for advertising team leader posts and interviewing applicants, and that the worker had less than two hours to respond to a notice. The company said it considered six eligible workers and selected the most suitable candidates. The Court accepted that the selection procedure differed and the application form was unsatisfactory, but found the appellant was not treated differently from other employees. It said the same people would have been selected even if the posts had been advertised and interviews held.
