In 1993, the Labour Court rejected Gresham Hotel’s appeal and upheld a Rights Commissioner’s recommendation concerning a Night Duty Manager’s permanent night shifts, pay and taxi provision. The Rights Commissioner had found that her terms and conditions were altered to her detriment and recommended an annual salary increase from £10,500 to £14,000, along with resuming taxi provision on Sundays and bank holidays.
The company argued that duty managers were expected to work flexibly according to the hotel’s needs. Services Industrial Professional Technical Union said the worker had been assigned permanent nights despite appointment terms providing for days and night relief. At the Labour Court hearing, the hotel said it was willing to restore the taxi provision. The Labour Court decision was dated 6 September 1993.
