Labour Court recommends cleaner’s appointment as supervisor at Cerebral Palsy Ireland

In 1992, the Labour Court recommended that Cerebral Palsy Ireland appoint a cleaner to the evening Cleaning Supervisor post at its Sandymount Clinic. The decision was dated 5 November 1992. Cerebral Palsy Ireland argued the vacancy should be filled through competition and that seniority alone did not give a cleaner a right to promotion. Impact said the post had customarily gone to the most senior cleaner and that the claimant had taken on supervisory responsibilities in a senior cleaner’s absence. The Court found the claimant had grounds to conclude she would have been appointed and recommended that she be appointed. It also recommended that Cerebral Palsy Ireland and Impact agree procedures for future appointments.
