In 1992, the Labour Court upheld a Rights Commissioner’s recommendation that a worker’s claim against St James’s Hospital Board should fail. The decision was dated 6 November 1992. The case concerned the worker’s application for a Senior Biochemist post, which the hospital said he could not be considered for because he lacked the required qualifications.

The worker, represented by the Medical Laboratory Technologists Association, argued that his professional fellowship, master’s degree and hospital laboratory experience met or equalled the requirements. The hospital said the post required a chemistry or biochemistry degree, or an accepted equivalent, and three years’ post-qualification experience. It also said the worker had not been employed as a biochemist.

The Labour Court decided that the Rights Commissioner’s recommendation should stand. The Court also agreed that the question of equivalency warranted further review by the interests concerned.
