In 1992, the Labour Court increased compensation to £2,000 for a worker whose chance of promotion at Aer Lingus was blocked by a local agreement. The decision was dated 7 January 1992. The Services Industrial Professional Technical Union appealed the Rights Commissioner’s £1,000 recommendation. The Court found the worker had not been told that the agreement would effectively prevent him from getting the Technical Storeperson job, or that the recruitment panel had closed. Although being placed on the panel was not a job offer, it gave him an expectation of an opportunity for promotion. The Court amended the recommendation to provide £2,000 in full and final settlement and recommended that Aer Lingus and T.E.A.M. reconcile inconsistencies in their agreements.
