In 1991, the Labour Court recommended that Maybin Industrial Limited withdraw a cleaner’s dismissal and replace it with unpaid suspension from the date of the incident. It recommended reinstatement from 11 February 1991 and a final written warning. The decision was dated 1 February 1991. The Services Industrial Professional Technical Union had appealed a Rights Commissioner’s recommendation about the cleaner’s alleged unfair dismissal. The Court found her response to instructions and attitude toward her supervisor unacceptable. It accepted that the supervisor was struck by the vacuum cleaner, but doubted the worker intended that when she threw it down.
