Labour Court leaves Briggs Amasco lay-off recommendation in place

The Labour Court left in place a Rights Commissioner’s recommendation that a worker laid off by Briggs Amasco Limited was not entitled to compensation for lost earnings. The decision was dated 13 July 1988, following an appeal by the Irish Transport and General Workers’ Union. The union said the company had breached seniority arrangements because two retained employees had less service. Briggs Amasco said there was no work available when the worker returned after sick leave and it would be unfair to displace someone already working. The Court found the company had not acted unreasonably in applying the seniority rule.
