In 1988, the Labour Court recommended that Smurfit Corrugated Cases Limited reduce a worker's proposed one-week suspension to three days, after Irish Transport And General Workers' Union appealed the Rights Commissioner's recommendation. The decision was signed on 31 March 1988. The dispute followed the worker's refusal to operate a forktruck after reporting faulty brakes. The company said the refusal was unreasonable; the union argued it was justified and said an engineer repaired the vehicles the next day. The Court found the worker's behaviour merited some disciplinary action, but considered a week's suspension excessive.
