The Labour Court rejected Coras Iompair Eireann's appeal and upheld a Rights Commissioner's recommendation for £1,050.06 compensation for a worker who lost overtime after a transfer. The decision was signed on 21 March 1988. The Transport Salaried Staffs' Association sought compensation after the worker moved from the Tours Department to a sales representative's position at Irish Rail Head Office. It argued that the work and overtime continued with other Tours staff. The company said declining business had caused staff cuts and the loss of overtime. The Court found that business had not declined in the area under the worker's control, so his transfer was not mainly due to a decline in business. It upheld the earlier recommendation; the decision did not make a separate award.
