The Labour Court upheld a recommendation that no unfair dismissal had occurred in Mr. Sean Donovan's appeal against Irish Rail. The decision was signed on 3 November 1987. Donovan said his retirement had been effectively forced after an occupational injury and estimated his losses at about £20,000. Irish Rail said he had chosen immediate ill-health retirement under its welfare scheme. He received a £2,380.50 gratuity on retirement. The Court found the Rights Commissioner's recommendation correct and let it stand.
