The Labour Court recommended that Longford County Council allow a worker incremental progression on the Grade VII scale from the date he lodged his claim in 2013. The decision was signed on 14 March 2017. The council had not moved him onto the scale when it realigned the Rapid Co-Ordinator post in 2011. The Court found he had won the role through open competition in 2002 and was not working in an acting capacity. It said the council’s reason for excluding him from the realignment was misconceived. The worker, represented by the Irish Municipal, Public and Civil Trade Union, had appealed an earlier recommendation rejecting his claim. The Court said its recommendation was limited to the particular facts of the case and did not set a precedent.
