The Labour Court rejected a worker’s appeal over weekend premium hours while he trained as a nurse, upholding the Rights Commissioner’s recommendation in full. The decision was signed on 9 December 2015. The worker, represented by the Services Industrial Professional Technical Union, said he had not been rostered for weekend shifts during academic terms and claimed an earnings shortfall of about €15,000. Health Service Executive South said weekend shifts would have required time off during college days or overtime. The Court found the worker had received full remuneration under the training circular and had no entitlement to premium hours during academic terms.
