The Labour Court rejected HSE Dublin Mid-Leinster’s appeal and upheld a €3,000 recommendation for a worker over its handling of a complaint about an offensive graphic in a staff room. The decision was signed on 17 April 2012. The HSE said the graphic was removed promptly and its investigation followed policy. The worker said management had not dealt with the matter quickly enough. The Court found the complaint was handled promptly when first brought to management’s attention, but that the HSE’s later processing was inadequate, incomplete and untimely. It said some correspondence could have been understood as warning the worker off pursuing the complaint, although that was not intended.
