The Labour Court rejected a worker’s appeal over Eircom Limited’s treatment of his car allowance and annual leave. Its decision was dated 13 December 2011. The Communications Workers' Union sought a pensionable car allowance and additional leave, arguing that the worker should have the same terms as other Partnership Coordinators. Eircom said his contract reflected terms agreed for newly appointed coordinators. The Court found the contract made the allowance non-pensionable and said Eircom should comply with any clarification from the Superannuation Scheme. It found the link to the Technical Team Leader grade applied only to pay, so the worker retained annual leave under his substantive TO grade. The Court varied the Rights Commissioner’s recommendation and rejected the appeal.
