The Labour Court dismissed a worker’s appeal over a vacancy on the seven-person porter roster at HSE Dublin Mid Leinster, affirming the Rights Commissioner’s recommendation. The decision was signed on 18 June 2010. The worker had covered a vacancy on the roster for two years without receiving its allowance and sought the next vacancy without an interview. The Court found a collective agreement required the post to be filled by competition and found no irregularity in how the agreement was concluded.
