The Labour Court varied a recommendation concerning a Tesco Ireland worker who had been demoted from a management role. If he maintained a clear record until the second anniversary of his demotion, he should be restored to his former grade at the first available opportunity in his region, with support and training. Mandate, representing the worker, sought restoration and back pay, saying he had been demoted after raising payroll concerns. Tesco Ireland said his communication difficulties and conduct warranted the transfer and regrading. The Court found his behaviour on 14 November 2009 warranted disciplinary action, but said it was unclear whether he understood its seriousness and that the concerns had not been clearly brought to his attention. The decision was signed on 4 June 2010.
