The Labour Court recommended that Wyeth Nutritionals Ireland pay a worker sick pay withheld after conflicting medical assessments left him without a way to resolve his fitness for work. The worker, represented by the Services Industrial Professional Technical Union, had supplied medical certification. The company said its occupational health physician considered his role and responsibilities as well as his fitness to work. The Court recommended that the company provide written details of the scheme, establish a procedure for resolving conflicting fitness assessments and notify workers of the consequences for sick pay. It said the worker was not responsible for the confusion and should receive the pay withheld. The recommendation was signed on 30 December 2010.
