Labour Court upholds €2,500 recommendation after Superquinn appeal

The Labour Court upheld a €2,500 recommendation to a worker dismissed by Superquinn after dismissing the company’s appeal. The decision was dated 9 April 2008. Superquinn said the worker breached clocking and cash register procedures during probation. The union argued that serious misconduct had not been clearly established and that fair procedures were not followed. The Court found that policy breaches occurred, but the company’s procedures and its failure to grant an appeal immediately fell considerably short of best practice. It also considered the dismissal sanction disproportionate. The upheld recommendation included compensation of €2,500 and a positive written reference.
