The Labour Court dismissed a worker’s appeal and confirmed a Rights Commissioner’s recommendation that his claim was not well founded. The decision was dated 10 December 2008. The worker, represented by the Services Industrial Professional Technical Union, said Ballina Town Council refused to certify an accident he reported at work, preventing him from obtaining Injury Benefit. The council said it had no evidence the incident happened during working hours, colleagues recalled no accident and the medical-certifier section of the form was incomplete. The Court urged both sides to develop a protocol for reporting accidents without witnesses.
