The Labour Court dismissed HSE West’s appeal and upheld a Rights Commissioner’s recommendation that it pay a retired midwifery tutor €15,000 net over a qualification allowance. The decision was signed on 2 December 2008.
The worker said she should have received the allowance from 1984 under an agreement reached in 2000. HSE West argued the allowance was not part of her terms when she took the post and that she had not shown she was covered by the agreement.
