Labour Court dismisses Diageo worker’s pension service appeal

The Labour Court dismissed a worker’s appeal over whether his apprenticeship and temporary service counted towards pensionable service at Diageo Kilkenny. Its decision was dated 17 December 2007. The union sought recognition of nine years and four months’ service, arguing that agreements and company practice supported the claim. The Court found the K2 Rationalisation Plan and Continuous Improvement Plan did not provide for buying back temporary or casual service. It reinstated the company’s offer of 18 months of notional service buyback, which the worker had rejected.
