Labour Court overturns recommendation on Sligo County Council transfer appeal

The Labour Court overturned a Rights Commissioner's recommendation on Sligo County Council's appeal, upholding its decision to transfer a worker after his fixed-term contract as a Workplace Partnership Facilitator expired. The Court dated its decision 30 November 2006. The union argued an agreement to extend facilitator posts meant the worker should remain in the role during a national review. The Council said the LGMSB letter extended the post, not the individual contract. The Court found the letter did not guarantee the postholder would stay and that reassignment was reasonable after the contract expired.
