The Labour Court overturned a recommendation against regrading two nurses employed by Health Service Executive-West, directing that they be regraded to CNMIII level from July 2002. The union argued their duties and responsibilities justified the higher grade; the HSE said the roles did not warrant it and cited restructuring and cost concerns.
The Court said the regrading was appropriate on a non-precedential basis, unique to the workers’ circumstances, after considering the claim’s history and forthcoming restructuring. The decision was dated 31 March 2006.
