The Labour Court allowed Cahill May Roberts Group PLC’s appeal and overturned a Rights Commissioner’s recommendation in favour of a worker’s claim for an extra day of service leave. The decision was dated 14 December 2005. The worker, represented by the Services Industrial Professional Technical Union, moved from warehouse work to a salaried administrative role in May 2000. The union argued administrative staff were not covered by a 1998 agreement that ended service leave for new employees. The company said the agreement applied and pointed to the worker’s contract, which provided 20 days’ annual leave. The Court relied on that contract in declining to recommend the claim. It also recommended that the company and the union branch discuss the scope of the 1998 agreement.
