Labour Court varies recommendation on Castlerea Formula claim by St Conals Letterkenny workers

In 2005, the Labour Court varied a Rights Commissioner recommendation in the union's appeal over Castlerea Formula compensation for two workers at St Conals Letterkenny. The Court's decision was dated 28 October 2005. The Services Industrial Professional Technical Union had appealed after the Rights Commissioner did not recommend in favour of its claim. The Court found Worker A chose to transfer to Community Care on promotion, so the formula did not apply to him. It found Worker B was allocated a post requiring a normal five-day week, so the formula applied to her. The Court varied the recommendation accordingly.
