The Labour Court upheld a Rights Commissioner’s recommendation against reinstating a worker dismissed by the South Western Area Health Board. It also recommended that the worker be given a reference without delay. The decision was dated 24 November 2004. The worker, a temporary clerical officer, was dismissed for poor work performance after a verbal warning and two written warnings. The union said performance concerns arose after the worker alleged bullying through isolation and argued the Board had not relocated her despite medical advice. The Board said she had not appealed the warnings, had not met its performance standard and had not returned to training after the first day. The worker appealed the recommendation. The Labour Court agreed with the Rights Commissioner’s findings and recommendation, dismissed the appeal and recommended a reference without delay.
