The Labour Court disallowed a worker’s appeal against a recommendation on the date for future pay increments after his promotion to senior administrative officer at An Bord Pleanala. The decision was dated 25 March 2004. The union argued that because the appointment had been backdated to 1 August 2000 for salary purposes, that date should count for future increments. The Court found the offer could be read as applying retrospectively to salary alone, in line with the Board’s practice and the understanding of other staff promoted at the same time. It affirmed the Rights Commissioner’s recommendation.
