Labour Court overturns re-engagement recommendation on Dublin City Council appeal

The Labour Court allowed Dublin City Council’s appeal and set aside a Rights Commissioner’s recommendation that a worker be re-engaged. The decision was signed on 4 November 2003. The worker, a clerical officer in the council’s rates office, also appealed but did not attend the Labour Court hearing. The Court found he had accepted retirement on ill-health grounds and that there was no unfair dismissal. It therefore allowed the council’s appeal and substituted its determination for the Rights Commissioner’s recommendation.
