Timothy Walsh’s appeal against a 15-year driving disqualification for dangerous driving causing serious bodily harm was dismissed by the Court of Appeal on 27 July 2017. He had pleaded guilty and received four years’ imprisonment, with the final year suspended, at Cork Circuit Criminal Court on 30 July 2014.
The offence happened on 7 August 2013 when Walsh drove an articulated truck while attempting to overtake a cyclist on a rising bend. The cyclist suffered life-threatening injuries and was confined to a wheelchair.
The Court of Appeal noted that the 42-tonne vehicle had failed a test on 70 grounds, including critical defects involving its brakes, lights and mirrors. Walsh was also stopped one month later driving the same vehicle while it remained unroadworthy. The court declined to reduce the disqualification.
