Thomas McMahon pleaded guilty to exposure at Dublin Circuit Criminal Court. The offence took place on a Dublin Bus in Crumlin on 28 June 2017.
The proceedings were reported on 28 November 2018. Judge Melanie Greally adjourned the case for sentence to “March 13th next” and ordered a psychiatric report for that date.
Garda Conor O’Neill told prosecuting counsel Siobhán Ní Chúlacháin BL that a woman felt McMahon’s penis on her shoulder when the bus jerked. She saw him standing behind her and said his penis was not erect. She screamed and ran to the driver.
Garda O’Neill agreed with defence counsel David Staunton BL that the woman had told gardaí the bus jerked forward when she noticed the contact. He accepted that McMahon, who said he could not remember the incident, thought he had most likely gone to the back of the bus to urinate and had urinary problems associated with alcohol and drug addiction.
Mr Staunton said McMahon had intended to urinate and that there was no sexual element to the contact. Garda O’Neill also accepted that McMahon was extremely remorseful and had taken steps to rehabilitate.
