Teva loses patent injunction bid against Mylan in Galway case

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Teva Pharmaceutical Industries Ltd had its patent-infringement injunction application refused by the High Court on 5 June 2018.

The case concerned Mylan’s generic glatiramer acetate drug, manufactured at its facility in Inverin, Co Galway, for export to the United States.

Teva alleged that the product infringed a patent covering low-frequency glatiramer acetate therapy and sought orders restricting its manufacture, sale and use. Teva was the patent’s exclusive licensee; Yeda Research and Development Co. Ltd. was its registered owner.

Mr Justice David Barniville said he was not persuaded that damages would be an inadequate remedy if Teva later succeeded at trial. He refused the interlocutory injunction and the other relief sought in the motion.
