Teresa Wall lost her €40,000 negligence claim at the High Court, in a judgment reported on 17 February 2017. She had fallen on a boardwalk on the Wicklow Way near Roundwood in 2013.

Mr Justice Michael White overturned the Circuit Court award after finding the National Parks and Wildlife Service was not negligent. He said there was a high degree of negligence on Ms Wall’s part because she was not looking at the boardwalk surface when she fell.

The judge adjourned the matter for two weeks while the parties considered his decision, including any application for legal costs.
