Shahzad Hussain’s murder conviction was quashed and a retrial ordered by the Court of Criminal Appeal, reported on 28 July 2014. The case concerned the alleged stabbing of Muhammad Arif at an apartment in Fitzwilliam Court, Dyer Street, Drogheda, on 6 January 2011.
The court found a very real risk of injustice because the original jury was incorrectly directed on provocation. Hussain had been sentenced to life for murder and also received sentences for seriously injuring and assaulting his wife.
The appeal court said the error had not been adequately remedied by a further jury direction or answers to the jury foreman. Hussain was remanded in custody pending arrangements to fix a Central Criminal Court retrial date.
