Sean FitzPatrick has pleaded not guilty to misleading auditors charges at Dublin Circuit Criminal Court, reported on 12 January 2017. The charges concern alleged statements about multimillion-euro loans between 2002 and 2007.

During the trial, a detective sergeant agreed that warrants used to search Anglo Irish Bank and Irish Nationwide premises had been ruled unlawful and unconstitutional. The trial continued, with the jury receiving documents seized during those searches.

The prosecution alleges that loans involving FitzPatrick, his wife and family members rose from about €10 million to around €100 million between 2002 and 2007.
