The Court of Appeal rejected Philip Dunbar’s challenge to the admission of CCTV evidence in his murder case. The proceedings were reported on 30 January 2024.
Mr Justice John Edwards said the court did not believe Dunbar’s rights had been breached under the Constitution, the European Convention on Human Rights or the EU Charter of Fundamental Rights. He described the CCTV challenge as misconceived.
The footage was obtained from private homes, local businesses and a Dublin bus. It showed public places including footpaths, roads, a park and the Square Shopping Centre in Tallaght.
Dunbar was convicted by a jury of murdering 23-year-old Adam ‘Floater’ Muldoon at Butler Park, Jobstown, Tallaght, on 22 or 23 June 2018. Dunbar was 17 at the time and stabbed Mr Muldoon 183 times in an unprovoked attack.
