Michael Kinsella's manslaughter term backdated after charging delay

Michael Kinsella's 15-year manslaughter term was backdated to 10 December 2014, while his uncle Wayne Kinsella had already received a life sentence for murdering Adil Essalhi. Justice Deirdre Murphy ordered the backdating at a hearing on 25 July 2016. The proceedings were reported on 25 July 2016.
The judge had imposed Michael Kinsella's 15-year term in June and had declined to suspend any of it. She recommended a one-third reduction by the Minister for Justice, conditional on genuine participation in addiction treatment, education and counselling in prison.
Michael Kinsella, 24, was from Swiftbrook Close in Tallaght. He had pleaded guilty to manslaughter the previous December. His plea concerned his involvement in the killing of Adil Essalhi at Tyrrelstown, Dublin, on 6 January 2011.
Adil Essalhi suffered 50 stab and slash wounds. Michael Kinsella acknowledged stabbing him, but the prosecution accepted that Wayne Kinsella, Michael Kinsella's uncle, caused most of the wounds.
Wayne Kinsella's murder conviction was in May 2012. Michael Kinsella was charged some months afterwards. Justice Deirdre Murphy said the delay between the investigation ending and Michael Kinsella being charged was the reason for backdating his term.
