Declan McLogan, a director of McAleer & Rushe UK Ltd, pleaded guilty on the company’s behalf at Dublin Circuit Criminal Court to undertaking work liable to expose employees to asbestos dust without a risk assessment. The proceedings were reported on 27 February 2020.

The breach occurred on 23 June 2016 during refurbishment work at Findlater House on Cathal Brugha Street, Dublin.

Health and Safety Authority inspector Frank Kearns agreed with defence counsel Ronan Kennedy SC that the area was outside the original conversion works, the rest of the site had been properly surveyed and any asbestos there had been dealt with in compliance with regulations. He also agreed that the site was otherwise wholly compliant with health and safety regulations.

Judge Melanie Greally adjourned the case for finalisation on 9 March 2020.
