Kerry greenway challenges get permission for judicial review

By Tadhg O'Sullivan

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Two High Court challenges to the proposed South Kerry Greenway received permission for judicial review on 14 January 2021, with a March hearing provisionally fixed. The cases concern An Bord Pleanála’s approval of the proposed 32km cycle and pedestrian route between Glenbeigh and Caherciveen. James Clifford and Peter Sweetman also obtained a stay on greenway works, while local landowners secured permission to challenge compulsory purchase orders affecting their properties.

The challenges raise claims concerning environmental assessment, habitats protection and the process used to confirm compulsory purchase orders. Kerry County Council told the High Court that the litigation could affect tourism, health and funding, while the court listed both cases for further case management before the provisional March hearing.
