The High Court has refused an application by ELON MUSK and X HOLDINGS CORP. to stay COIMISIÚN NA MEÁN’s investigation into suspected contraventions of Article 20 of the Digital Services Regulation by the provider of the X Service. Mr Justice Mark Dunne delivered the judgment on 31st July 2026.
The court said the Direction and Notice of Commencement were prima facie valid and that the public interest substantially outweighed the factors supporting a stay. The interim stay in place therefore lapsed. The substantive judicial review challenge remained pending in the supplied judgment.
