Kevin Hannaway, Eva Shannon, Sean Hannaway, David Nooney and Edward O'Brien had their convictions upheld by the Court of Appeal on 6 February 2020. Hannaway and Shannon were convicted of providing assistance to an unlawful organisation, while Sean Hannaway, Nooney and O'Brien were convicted of membership of an unlawful organisation.
The convictions arose from events at a property in Riverwood Park, Castleknock, Dublin, on 7 and 8 August 2015, where the prosecution relied principally on audio recordings of an alleged internal IRA inquiry.
The appellants challenged issues including belief evidence, surveillance material, the admissibility of recordings, arrests and the Special Criminal Court's jurisdiction. The Court of Appeal rejected their complaints and dismissed each appeal against conviction.
The judgment dealt with the conviction appeals only. It did not determine the separate sentence appeals or the Director of Public Prosecutions' sentence reviews.
