The High Court refused Helen Fitzgerald’s request to adjourn the repossession case involving Davy Fitzgerald, reported on 19 June 2023.
The application was brought by receiver James Anderson, appointed by Pepper Finance Ireland DAC, over a house owned by Davy Fitzgerald in Clonara, Sixmilebridge, Co Clare.
Helen Fitzgerald said she was a tenant and had referred the matter to the Residential Tenancies Board. Judge Garrett Simons ruled that the High Court should determine whether she could assert a binding tenancy against the plaintiffs.
The judge said the Board did not have exclusive jurisdiction to decide whether a valid tenancy existed. He directed that the repossession proceedings be readied for a High Court hearing.
