Davy Fitzgerald alleges fraud in Portuguese mortgage proceedings

By Ruairí Dolan

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Davy Fitzgerald alleged fraud over Portuguese mortgage documents in High Court proceedings reported on 25 October 2022. He said he discovered that his name had been placed on documents relating to six or seven properties without his knowledge or consent.

Fitzgerald sued ACC Loan Management and Jarlath Mitchell, seeking damages for alleged fraud, negligence and deceit. He also said €45,000 held on deposit with ACC was unaccounted for.

Separately, a possession case brought by Pepper Finance and receiver James Anderson against Fitzgerald and his sister was struck out after the plaintiffs’ representatives failed to appear. The plaintiffs’ lawyers sought reinstatement shortly afterwards; Fitzgerald’s lawyers opposed it. The Deputy Master said he lacked power to reverse the decision without the parties’ consent, and expected the matter to return to court soon.
